These terms and conditions govern the use of services and website provided by TinyCode Labs. By using our services, you agree to be legally bound by these terms. If you do not agree with these terms, you should not use our services.

1. Acceptance of Terms

By accessing, browsing, and using our services and website, you agree to be bound by these terms and conditions, our privacy policy, and all applicable laws and regulations. You acknowledge that you have read, understood, and accepted these terms. If you use our services on behalf of an organization, you represent that you have the authority to bind such organization to these terms.

2. Service Description

TinyCode Labs provides professional software development services, technology consulting, mobile and web application development, and custom digital solutions for businesses and organizations. Our services include, but are not limited to: application development (Taskify, Romantic Quotes), software consulting, SEO optimization, and custom website development. Specific details of each service will be established in separate contractual agreements when applicable.

3. User Responsibilities

Users agree to: (a) use our services legally, ethically, and in accordance with these terms, (b) provide accurate, complete, and updated information when necessary, (c) not use our services for illegal, harmful, or fraudulent activities, (d) not interfere with the normal operation of our systems, (e) not attempt to gain unauthorized access to our systems or data, and (f) respect all intellectual property rights.

4. Intellectual Property

All content, software, code, designs, graphics, logos, and materials developed by TinyCode Labs are protected by copyright, trademarks, and other intellectual property laws. You may not copy, modify, distribute, sell, or exploit any content without our prior written consent. For custom projects, intellectual property rights will be specified in the corresponding service contract.

5. Warranties and Services

We strive to provide high-quality services. However, our services are provided 'as is' and 'as available'. We do not guarantee that our services will be uninterrupted, error-free, or completely secure. For custom development projects, specific warranties will be established in the service contract. Any applicable warranty will be limited to a specific period after project delivery.

6. Limitation of Liability

To the maximum extent permitted by law, TinyCode Labs shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses that may arise from the use or inability to use our services. Our total liability in any case shall not exceed the amount paid by you for the specific services that gave rise to the claim during the 12 months prior to the event giving rise to liability.

7. Indemnification

You agree to indemnify, defend, and hold harmless TinyCode Labs, its directors, employees, and agents from any claim, demand, loss, liability, and expense (including reasonable attorneys' fees) arising from: (a) your use of our services, (b) your violation of these terms, (c) your violation of third-party rights, or (d) any content or information you provide.

8. Modifications to Terms

We reserve the right to modify these terms at any time. Modifications will take effect immediately upon posting on this page. Your continued use of our services after any changes constitutes your acceptance of the new terms. For substantial changes, we will make reasonable efforts to notify users, such as posting a prominent notice on our website.

9. Termination

We reserve the right to suspend or terminate your access to our services at any time, without prior notice, for any reason, including if we believe you have violated these terms. Upon termination, all licenses and rights granted to you will cease immediately. Provisions that by their nature should survive termination (such as limitations of liability, indemnifications, and applicable law) will continue in effect.

10. Governing Law and Jurisdiction

These terms shall be governed by and construed in accordance with the laws of the Republic of Colombia, without giving effect to any principles of conflicts of law. Any dispute relating to these terms shall be subject to the exclusive jurisdiction of the competent courts of Medellín, Colombia. If you access our services from outside Colombia, you are responsible for compliance with local laws.

11. Dispute Resolution

In the event of any controversy or claim arising from these terms or our services, the parties agree to first attempt to resolve the dispute informally by contacting us directly. If the dispute cannot be resolved informally within 30 days, the parties may seek mediation before initiating any legal or arbitration proceedings. This requirement does not prevent either party from seeking urgent injunctive relief when necessary.

12. Force Majeure

TinyCode Labs shall not be liable for any delay or failure in performance of these terms due to causes beyond our reasonable control, including but not limited to natural disasters, wars, civil unrest, telecommunications or Internet failures, strikes, government regulations, pandemics, or other force majeure events.

13. General Provisions

If any provision of these terms is deemed invalid or unenforceable, such provision will be modified and interpreted to achieve the objectives of such provision to the greatest extent possible, and the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these terms will not constitute a waiver of such right or provision. These terms constitute the entire agreement between you and TinyCode Labs with respect to our services.
